TERMS & CONDITIONS: THE APRIL 21-CLASS CHALLENGE
THESE RULES ARE THE STANDARD TERMS AND CONDITIONS APPLICABLE TO THE GIVEAWAYS ADMINISTERED BY SWEAT AND TONIC INC. DURING THE APRIL 21-CLASS CHALLENGE (THE “GIVEAWAY”). GIVEAWAYS ARE INTENDED TO BE CONDUCTED IN THE PROVINCE OF ONTARIO ONLY AND SHALL BE CONSTRUED AND EVALUATED ACCORDING TO APPLICABLE CANADIAN LAW. NO PURCHASE IS NECESSARY. VOID IN WHOLE OR IN PART WHERE PROHIBITED BY LAW. ENTRY IN THE GIVEAWAYS CONSTITUTES ACCEPTANCE OF THESE RULES (THE “GIVEAWAY RULES”).
1. Eligibility
The contest is open to legal residents of Ontario, Canada, who have reached the age of majority (18 years or older) at the time of entry. Employees, contractors, officers, directors, and agents of Sweat and Tonic Inc., its affiliates, and/or their immediate family members or persons living in the same household, are not eligible to enter the Giveaway unless otherwise specified by the Sponsor.
2. Sponsor
The Giveaway is sponsored by Sweat and Tonic Inc. (the “Sponsor”). The Sponsor shall have the right at any time to require proof of identity and/or eligibility to participate in the Giveaway. Failure to provide such proof may result in disqualification. All personal and other information requested by and supplied to the Sponsor for the purpose of the Giveaway must be truthful, complete, accurate and in no way misleading. The Sponsor reserves the right, in their sole discretion, to disqualify any entrant should such an entrant at any stage supply untruthful, incomplete, inaccurate or misleading personal details and/or information.
3. Giveaway Period
The period begins on April 1, 2026 and ends on April 30, 2026 (the “Giveaway Period”).
4. How to Enter
No purchase necessary. To enter, participants must complete 21 classes in full at Sweat and Tonic and/or Reformd to be entered into the grand prize draw, and an additional 9 pool deck / biohacking sessions (red light therapy, compression therapy, hot/cold therapy) to be entered into the bonus prize draw. Classes / sessions must be booked with S&T/Reformd credits or membership. Overlapping classes, sessions, attendance, and/or accounts in violation of the Club Code of Conduct are ineligible. Limit of one (1) entry per person unless otherwise stated.
5. Prize Details
There are two (2) grand prizes and two (2) bonus prizes available to be won:
Description of Grand Prize: 3-month S&T & Reformd Unlimited membership
Total Approximate Retail Value (ARV): $1,410 CAD
Description of Bonus Prize: 30-pack of recovery credits redeemable for biohacking (red light therapy, compression therapy, hot/cold therapy), and the pool deck. Credits expire 6 months from date of issue.
Total Approximate Retail Value (ARV): $790 CAD
The prize must be accepted as awarded and has no cash value. No substitutions, transfers, or extensions are permitted, except at the Sponsor’s sole discretion. All incidental costs and expenses not specifically referred to herein as part of the prize description (the “Expenses”) including but not limited late cancellation and no show fees are the sole responsibility of the prize winners, where applicable. All prize elements are subject to availability and substitution. The winner shall not seek reimbursement for the Expenses from the Sponsor. Any unused portion of a prize will be forfeited and have no cash value. The Sponsor reserves the right, in its sole discretion, to substitute a prize of equal or greater value if a prize (or any portion thereof) cannot be awarded for any reason. The Sponsor shall not assume any liability for lost, damaged or misdirected prizes.
6. Winner Selection
A random draw will be conducted on or about May 6, 2026 from all eligible entries received during the Giveaway Period. Odds of winning depend on the number of eligible entries received.
7. Skill-Testing Question
Before being declared a winner, the selected entrant must correctly answer, without assistance, a time-limited mathematical skill-testing question as required by Canadian law.
8. Winner Notification
The selected entrant will be contacted via email within ten (10) days of the draw. If the selected entrant does not respond within fourteen (14) days, fails to answer the skill-testing question correctly, or does not meet eligibility requirements, they may be disqualified and an alternate winner may be selected. The selected entrant may be required to sign and return a declaration and release form within the timeframe specified by the Sponsor.
9. Release and Limitation of Liability
By participating, entrants agree to release and hold harmless Sweat and Tonic Inc. their affiliates, and their directors, officers, employees, and agents from any and all liability arising from or relating to participation in the giveaway or acceptance, use, or misuse of any prize.
10. Privacy
Personal information collected will be used solely for the administration of the Giveaway and in accordance with the Sponsor’s Privacy Policy. Personal information may be shared solely as necessary to administer the prize. Information will not be shared with third parties without consent, except as required by law or as necessary to fulfill the prize obligations.
11. General Conditions
The Sponsor reserves the right to cancel, suspend, or modify the giveaway at any time if fraud, technical failure, or any other factor beyond its reasonable control interferes with the proper conduct of the Giveaway. The sponsor reserves the right to withdraw its prize sponsorship if it determines, in its sole discretion, that continuing to participate would violate applicable laws or regulations or its internal policies.
12. Limitation of Liability
The Sponsor assumes no responsibility or liability for lost, late, unintelligible/illegible, falsified, damaged, misdirected or incomplete entries, notifications, responses, or replies,, or for any computer, online, software, telephone, hardware or technical malfunctions that may occur, including but not limited to malfunctions that may affect the transmission or non-transmission of an entry. The Sponsor is not responsible for any incorrect or inaccurate information, whether caused by website users or by any of the equipment or programming associated with or utilized in the Giveaway or by any technical or human error which may occur in the administration of the Giveaway. The Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. The Sponsor is not responsible for any problems, failures or technical malfunction of any telephone network or lines, computer online systems, servers, providers, computer equipment, software, e-mail, players, or browsers, on account of technical problems or traffic congestion on the Internet, at any website, or on account of any combination of the foregoing or otherwise. The Sponsor is not responsible for any injury or damage to any entrant or to any computer related to or resulting from participating or downloading materials related to the Giveaway. Entrant assumes liability for injuries caused or claimed to be caused by participating in the Giveaway, or by the acceptance, possession, use of, or failure to receive any prize. The Sponsor assumes no responsibility or liability in the event that the Giveaway cannot be conducted as planned for any reason, including those reasons beyond the control of the Sponsor, such as infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or corruption of the administration, security, fairness, integrity or proper conduct of the Giveaway and/or the Website.
13. Intellectual Property
All intellectual property, including but not limited to trade-marks, trade names, logos, designs, promotional materials, web pages, source code, drawings, illustrations, slogans and representations are owned by the Sponsor and/or their affiliates. All rights are reserved. Unauthorized copying or use of any copyrighted material or intellectual property without the express written consent of its owner is strictly prohibited.
14. Termination
Sweat and Tonic Inc. reserves the right, in their sole discretion, to terminate any Giveaway, in whole or in part, and/or modify, amend or suspend a Giveaway, and/or the Giveaway Rules in any way, at any time, for any reason without prior notice.
15. Governing Law
The Giveaway is governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.
16. Social Media
This Giveaway is in no way sponsored, endorsed or administered by any social media platforms on which the Giveaway may have been promoted and/or publicized, including but not limited to Instagram, Facebook, TikTok and/or X. Any personal information provided in connection with the Giveaway is being provided to Sweat and Tonic Inc. and not to Instagram, Facebook, TikTok and/or X. Any questions or comments regarding a Giveaway must be directed to the Sponsor and not to any of the social media platforms on which the Giveaway may have been advertised or administered.
