Sweat and Tonic understands the importance of your privacy, and we want you to be as comfortable as possible visiting our site and using our services. This privacy policy governs the manner in which Sweat and Tonic collects, uses, maintains and discloses information collected for users of the www.sweatandtonic.com website. This privacy policy applies to the website and all products and services offered by Sweat and Tonic, including affiliate organizations. We hope this will help you make an informed decision about sharing personal information with us. Please read this privacy policy before using our site or submitting any personal information. You are encouraged to review the privacy policy whenever you visit the site to make sure that you understand how any personal information you provide will be used.
Personal data is data related to a living individual who can be identified from that data. This can also include special categories of personal data (personal data revealing racial or ethnic origin, politic opinions, religious or philosophical beliefs, trade union membership, and genetic data, biometric data, health data and data concerning a person’s sex life or sexual orientation) and personal data related to criminal convictions and offenses.
The Sweat and Tonic entity responsible for processing your personal data will depend on how you interact with Sweat and Tonic (whether via website or other communication channels, or at our physical club). The relevant Sweat and Tonic entity is referred to as “Sweat and Tonic”, “S&T”, "Reformd", “our”, “we” or us” in this privacy policy.
Sweat and Tonic, Inc (225 Yonge Street, Toronto, Ontario, M5B 1N8) is responsible for your purchases of products and services, and for your participation in certain events and promotions.
OUR WEBSITE
We may collect personal identification information in a variety of ways, including, but not limited to, when users visit our site, register on the site, subscribe to the newsletter, and in connection with other activities, services, features or resources we make available on our website. Users may be asked for, as appropriate:
• Name
• Email address
• Mailing address
• Work address
• Date of birth
• Telephone number
• Credit card information
• Profile photo (required for certain memberships – see “Profile photos and identity verification” below)
Users may, however, visit our site anonymously. We will collect personal identification information from users only if they voluntarily submit such information to us. Users can always refuse to supply personal identification information, but this may prevent them from engaging in certain website related activities.
We may also collect non-personal identification information about users whenever they interact with our website. Non-personal identification information may include the browser name, the type of computer and technical information about users’ means of connection to our website, such as operating system and the internet service providers utilized and other similar information.
Where we do collect your personal data, this information is required for us to validate who you are, to deal with your queries effectively and to ensure that we can monitor usage of our sites as you register, purchase credits and book services.
If you book in to attend one of our classes or services, we will also collect information relating to your health status and any physical impairments that might impact upon how you can use our services. This is to ensure that we take your health record into account and can enable you to consider whether it is safe for you to attend classes.
PROFILE PHOTOS AND IDENTITY VERIFICATION
What we collect and why. From August 31, 2026, a current profile photo is a required element of your account if you hold a monthly credit pack, Unlimited, 9 to 5 Sweat, Club Transcend, or pool deck membership. We ask for this photo so that our team can confirm at check-in that the person using a membership is the member it belongs to. This protects the value of your membership, helps us enforce the rules against membership sharing and multiple accounts set out in our Terms & Conditions, and supports the safety and security of our Facilities by helping us know who is in the building.
How we use it. Your profile photo is used only for identity verification at check-in and for the administration and enforcement of your membership. We do not use your profile photo for marketing, promotional or social media purposes. We do not use it for facial recognition, automated matching or any other biometric processing, and we do not create a biometric template or faceprint from it. Any future use of your photo for a materially different purpose would require your fresh consent.
Who can see it. Your profile photo is visible to authorized Sweat and Tonic team members in the course of check-in and account administration. It is not visible to other members or to the public.
Where it is stored. Your profile photo is stored in Mariana Tek, the booking and member management platform we use as a service provider. Mariana Tek processes this information on our behalf and under contract, and may store or process it on servers located outside of Canada, including in the United States, where it may be subject to lawful access requests under the laws of those jurisdictions.
How long we keep it. We keep your profile photo for as long as you hold an active account, and delete it within a reasonable period after your account is closed, unless a longer period is required or permitted by law. You can replace your photo at any time in the S&T app.
Your consent and your choices. By uploading a profile photo you consent to our collecting and using it as described in this section. You may withdraw that consent, or ask us to delete your photo, at any time by contacting hello@sweatandtonic.com. If you do, we may need to verify your identity at check-in by other reasonable means, such as asking to see photo identification. Where the account holder is a minor over the age of 16, a photo may only be uploaded with the involvement and consent of the parent or guardian associated with the account.
If a photo is not accessible to you. If a standard profile photo is not accessible to you for religious, medical, accessibility or other personal reasons, please contact hello@sweatandtonic.com and we will work with you to arrange a reasonable alternative on an individual basis.

We may record telephone conversations or phone calls that you make to us. During these calls, we may collect information from you such as, but not limited to:
• Name
• Contact details
• Your S&T account email address
We process this information where it is necessary for the performance of our contract with you, to provide customer support, and to improve the quality and efficiency of our services. We use these recordings and related information to train and improve our customer support systems, including automated and AI-based call-handling tools.

Our email and/or text message correspondence may be kept as a record of your contact with us, and to enable us to respond to any queries that you may have.
HOW AND WHY WE USE YOUR INFORMATION
We collect and process personal information about visitors to our website, clients, customers and users of/visitors to our sites. We do this in order to deliver services to you, deliver merchandise to you when you make a purchase, process payments that you make to Sweat and Tonic and learn how to offer you a better product.
We may collect and use your personal information for the following purposes, all of which is for our legitimate interest of delivering services and products to you, and/or where it is necessary for the performance of our contract with you:
• To improve customer service – information you provide us helps us respond to your customer service request and support your needs more efficiently
• To personalize the user experience – we may use information in the aggregate to understand how our users as a group use the services and resources provided on our website.
• To improve our website – we may use feedback you provide to improve our products and services.
• To process payments – we may use the information you provide about yourself when placing an order only to provide service to that order. We do not share this information with outside parties except to the extent necessary to provide the service.
• To run a promotion, contest, survey or other feature
• To send users information which is relevant to services that they have purchased from us.
• To send periodic emails – we may use the email address to send users information and updates pertaining to their order. It may also be used to respond to their enquiries, questions, and/or other requests. We may also send emails to users that may include company news, updates, related product or service information, etc. If at any time you would like to unsubscribe from receiving future emails, we include detailed unsubscribe instructions at the bottom of each email.
• To verify your identity and protect your membership – we use your profile photo, together with your check-in and booking records, to confirm that the person using a membership is the member it belongs to, and to detect and investigate membership sharing and the use of multiple accounts.
COOKIES
Our website may use “cookies” to enhance user experience. Users’ web browsers place cookies on their hard drive for record-keeping purposes and sometimes to track information about them. Users may choose to set their web browser to refuse cookies, or to alert you when cookies are being sent. If they do so, note that some parts of the website may not function properly or optimally. WHO WE SHARE WITH
Like most companies, we do use third party companies to provide some parts of our service. When you are making payments, for example, you will need to give your payment details to our payments provider. Our booking and member management platform, Mariana Tek, stores your account information, including your profile photo, on our behalf.
We may also have to disclose your personal details if required by law.
If we do share your information with other organizations, we will have sharing protocols in place to ensure the organization’s compliance with local data protection laws.
We will not use your personal information for third party marketing purposes without your prior express consent.
We do not sell, trade, or rent users’ personal identification information to others. We may share generic aggregated demographic information not linked to any personal identification information (i.e. in an anonymized form) regarding visitors and users with our business partners, trusted affiliates and advertisers for the purposes outlined above.
Some of our service providers, including Mariana Tek, are located outside of Canada or use servers outside of Canada. Where your personal information is stored or processed outside of Canada, it is protected by contractual safeguards but may also be subject to lawful access requests by courts, law enforcement and national security authorities in that jurisdiction.

YOUR RIGHTS
If you wish to see a copy of the personal data we hold about you, ask us at any time and we will respond within the time periods laid down in local data protection laws.
Under certain circumstances, you also have the right to:
• Request correction of the personal information that we hold about you
• Request erasure of your personal information. This enables you to ask us to delete or remove personal information where there is no good reason for us continuing to process it.
• Object to processing your personal information where we are relying on a legitimate interest (or those of a third party) and there is something about your particular situation which makes you want to object to processing this ground.
• Request the restriction of processing your personal information. This enables you to ask us to suspend the processing of your personal information about you, for example, if you want us to establish its accuracy or the reason for processing it.
• Request the transfer of your personal information to another party.
Where we process your personal information because we have your consent to do so, you may withdraw your consent at any time.
These rights apply to your profile photo in the same way as to the rest of your personal information. You can replace your photo yourself at any time in the S&T app, and you can ask us to delete it by contacting us. Our handling of your personal information is subject to the Personal Information Protection and Electronic Documents Act (PIPEDA) and other applicable privacy laws. If you are not satisfied with how we have handled your information or a request you have made, you may also make a complaint to the Office of the Privacy Commissioner of Canada.
